A group of TikTok users has filed a lawsuit to challenge Montana’s statewide ban on the app, claiming that the ban violates their First Amendment rights. The complaint was filed in the US District Court for the District of Montana shortly after Governor Greg Gianforte signed the ban into law. The plaintiffs argue that Montana does not have the authority to prevent residents from accessing or creating lawful speech on TikTok, comparing it to other forms of media. They assert that the state cannot ban TikTok any more than it can ban a newspaper like the Wall Street Journal based on its ownership or published ideas. The lawsuit is notable as it is one of the first challenges to a ban that goes beyond restrictions on government devices and seeks to prohibit TikTok’s operation in the state and block downloads on personal devices, though individual use would not be penalized. The ban is scheduled to take effect in January. Montana’s Attorney General’s office has stated that they are prepared to defend the law against the legal challenge. The lawsuit also argues that the ban violates the Fourteenth Amendment by depriving TikTok users of other rights without due process and that it conflicts with federal authority over foreign policy and interstate commerce, as well as the International Emergency Economic Powers Act.
