The following article is an extract from my book-38 years of Sellingbringing out the gross negligence which has been happening in the medical profession by some of our negligent doctors. Some acts might have been carried away inadvertently, but then anything happening adversely to humankind out of mere negligence is a huge unfortunate happening and, of course, deplorable. 

Read it and be always vigilant and careful, at least for yourself first.

Now and then we listen to the grave negligence committed by the Medical professionals on the patients (human beings) and in most such cases, the patients either lose some parts of their bodies or even lose their lives. Sometimes the negligence can be because of certain factors where the full blame may not be given to the Medical professionals alone but if somebody’s left leg was to be amputated and instead, the right leg was amputated- what would you call such negligence-“ Blunder”.

Recently, such a blunder was caused in Delhi by two Orthopaedic surgeons and this was very much in the news for quite some time. But before we talk about it in detail, let me tell you that such negligent things have been happening all around the world and it is estimated as per Hopkin’s Research report that around 250,000 such bigger or smaller negligent cases have been seen to be happening every year around the universe. The Deaths because of this Medical Negligence are coming to number the third position in the list of casualties happening after the first being that of Heart Ailments and the second occupied by patients dying because of Cancer problems.

Now let me elaborate for those who don’t know about this case, which is of a 24-year-old boy Ravi Rai-who had a fall from the staircase and had an injury to the right ankle. Instead of his right leg, his left leg was operated upon and the right remained untouched, which needed medical intervention.

“The disciplinary committee of the Delhi Medical Council (DMC) found the doctors negligent for operating on 24-year-old Ravi Rai’s left ankle instead of the right one that needed surgery at Fortis, Shalimar Bagh. He was taken to the hospital after taking a fall from a staircase on June 19. When Rai woke up after the surgery with his left leg plastered instead of the right on June 21, he sent a photograph of his foot to his parents from the recovery room. Two doctors have been struck off Delhi’s state medical register for six months for operating on the wrong foot of a patient and then fudging hospital records to cover up their negligence. With their medical licenses suspended, orthopedic surgeons Dr. Ashwini Maichand and Rahul Kakran cannot practice medicine anywhere in the country for six months. When the media contacted the surgeons-they just apologized and said that it happened by mistake. And reassured that it was a simple procedure and they would just have to remove the screws from the left leg and put it in the right one,” said his father Ramkaran Rai.”

There are so many such cases that have been discussed whenever they came to light by the common public, even so, some of them which have left an impact on the memories of the people are worth mentioning here. I am reminded of another such case of a doctor herself who lost her precious life as she had come to Kolkata, her native state from the USA, and she fell ill. She had acute pain and fever with rashes and she went to a doctor for treatment-who gave her a higher-level dose of steroids even in the injectable form-unfortunately she could not tolerate the same and finally succumbed to death. Her name was Dr.Anuradha Saha. This case was a historical case since in it the Supreme Court Of India levied a huge compensation which finally turned out to be around Rs.11.00 crores inclusive of interests to the hospital to which that doctor belonged. It was a two-judge bench, and the penalty was appreciated by all since it started a new protective and cautious path for the Medical professionals to follow, otherwise, the huge compensations would crumble their very existence.

The third case which comes to mind is that of the Bihar woman who had gone for Eye Surgery and in the recovery phase in the hospital she asked for water to be given so that she would swallow her medicines. The nurse instead of water gave her a glass of acid-which she drank fully. Unfortunately, she too collapsed finally here the negligence has not been because of the doctor but because of the paramedical staff and the poor lady had to lose her precious life.

We have heard many such cases also where the instruments have remained inside the abdomen after the surgeries were over and the suturing was also done and the patients were told to go back to their places. I remember I was just a school-going student and those days in one of the abdominal surgeries, the doctor, by negligence, had forgotten to take out the scissors from the patient’s abdomen and his abdomen was sutured back. After quite some time the patient started complaining of acute pain in the abdomen and after the proper radiography, this was detected that the doctor had not taken oy the scissors. Immediate surgery was planned, and the patient was relieved of that scissors’ pain in the abdomen. Why this example is given because a similar case has just happened here in Mathura in March month after the head surgery. The doctors left a needle in the head of a six-year-old after he underwent head surgery. Bansi was left with the needle in his head and his family alleged medical negligence.

In January, a four-month-old baby died at the hospital in Delhi after the doctor gave a painkiller to provide relief to the stitches in the upper lip. The family alleged negligence. The incident took place in Jaipur Golden Hospital in Rohini on January 17.

JAIPUR GOLDEN HOSPITAL DELHI.

In another such case, a senior doctor at the AIIMS (All India Medical Institute) in Delhi is now facing trouble as he gave the wrong treatment to his patient, identified as Rekha Devi. The patient is a resident of Bihar, and sought treatment for abdominal pain. During this time, her kidneys were examined and there were no kidney ailments found. She was put on dialysis for no fault of hers and continued the same dialysis procedure. A committee has been formed in AIIMS under the chairmanship of Dean Dr. Y K Gupta after a probe into the matter was requested. The doctor has reportedly been indicted and has been asked to withdraw from all clinical work.

Medical practitioners from all fields of medicine, such as Allopathic, Homeopathy, and Naturopathy, can be liable under the Consumer Protection Act. The duties that a doctor owes to his patient are clear.

The four Ds of medical negligence is duty, dereliction, direct causation, and damages. All four elements must be proven for malpractice to be found.

Keep foreign objects inside. Surgical tools and items left inside of a patient after surgery are a common form of medical malpractice. Common medical instruments left behind include needles, scalpels, clamps, scissors, sponges, electrical equipment, and knife blades, among other objects.

A patient approaching a doctor expects medical treatment with all the knowledge and skill that the doctor possesses to bring relief to his medical problem. The relationship takes the shape of a contract, keeping the essential elements. A doctor owes certain duties to his patient and a breach of these duties gives a cause of action for negligence against the doctor. The doctor must get prior informed consent from the patient before carrying out diagnostic tests and therapeutic management.

Finally, I will conclude with the very shocking and revealing story of the death of Michael Jackson-whose own personal doctor Dr.Conrad Murray handled his death and was charged by the judge with $100 million to be paid as restitution to the Jackson Family. It was 25th June 2009 when the world was shocked to know about the sudden death of the Pop sensation. After an extensive autopsy and toxicological reports, it was found that Jackson died because of several drugs found in his body stream. One such was Propofol-a powerful anesthetic normally used in major surgeries. Further investigations revealed that Dr. Murray was giving this drug routinely to him for quite some time so that he could have a sound sleep-which he was not having. Based on this, the judge adjudged him guilty and penalized him accordingly. Now-what do you call this? It is also a “big blunder” but probably not a negligence case-much as the doctor expressed his ignorance of the fact that the drug would cause such a lethal outcome.
