Apple sues OpenAI alleging trade secret theft
Apple has filed a major lawsuit against OpenAI, accusing the AI company of encouraging Apple employees applying for jobs to bring confidential product prototypes, engineering documents, and hardware components to job interviews.
According to Apple, these alleged actions were part of a larger effort by OpenAI to speed up the development of its own AI-powered consumer devices.
What Is Apple Alleging?
Apple claims that OpenAI asked candidates interviewing for hardware-related positions to give detailed presentations about their work at Apple. The lawsuit says applicants were encouraged to bring confidential materials, including:
- Product prototypes
- CAD and design files
- Batteries
- Logic boards
- Hardware components
- Other engineering artifacts
Apple argues that these materials contained trade secrets and should never have left the company’s offices.
Former Apple Executive Named in Lawsuit
The lawsuit also names Tang Yew Tan, Apple’s former Vice President of Product Design for the iPhone and Apple Watch, who is now OpenAI’s Chief Hardware Officer.
Apple alleges Tan used confidential Apple project code names during interviews to question candidates about unreleased products. According to the complaint, one employee even responded that they “didn’t even know we could take those from the office.”
Additional Claims Against Former Employees
Apple also accuses former engineer Chang Liu of accessing Apple’s internal systems after leaving the company. The lawsuit claims Liu downloaded confidential engineering files while working at OpenAI and advised another Apple employee on how to avoid Apple’s security procedures before changing jobs.
Apple further alleges that OpenAI benefited from confidential knowledge about Apple’s supplier relationships while building competing hardware products.
Apple Says It Is Protecting Its Innovations
In a statement, Apple said protecting its technology and intellectual property is a top priority.
The company stated that it has found significant evidence suggesting some OpenAI employees improperly took confidential information related to Apple’s unreleased products, technologies, and development processes.
OpenAI Yet to Respond
At the time the lawsuit became public, OpenAI had not issued a response to requests for comment.
Apple Wants Court Action
Apple is seeking financial damages and court orders requiring the return of any confidential materials. It also wants to prevent any future use of its alleged trade secrets and preserve evidence related to the case.
Why This Lawsuit Matters
The lawsuit highlights growing competition in the AI hardware industry. It is especially notable because Apple and OpenAI continue to work together through ChatGPT’s integration into Apple Intelligence, even as Apple accuses OpenAI of misusing confidential information to build competing products.
If Apple’s allegations are proven in court, the case could have significant implications for trade secret protection, employee recruitment practices, and competition in the rapidly evolving AI hardware market.
